(hereinafter, the “App”). We value the trust you place in us.

TO READ THIS PRIVACY POLICY CAREFULLY WHEN USING OUR APP AND/ OR SERVICES. THE
MERE ACT OF DOWNLOADING THIS APP, EVEN WITHOUT READING THE SUBJECT LEGAL
DOCUMENT, WILL BE VIEWED AS ACCEPTANCE OF THE TERMS CONTAINED IN THIS PRIVACY
POLICY.
This Privacy
Policy applies to the JainJeevan App located at https://play.google.com/store/apps/details?id=com.jainjeevan.store
(hereinafter, the “JainJeevan App”
or the “App”) which is owned and controlled by JainJeevan Services LLP, having
its registered office at C2-Wing Flat No-1, 383, Bhawani Peth, Padamjee
Paradise Society, Pune-411042, Maharashtra, India (hereinafter, the “Fiduciary” or the “Processor”).
“JainJeevan”, “our” or “we” prioritize
the privacy of our users, and have developed this privacy policy to show our
commitment to that and to explain how we use certain data (“Privacy Policy”). This Privacy Policy
is intended to explain to you, as a user of JainJeevan or our membership/
subscriber based services (hereinafter “Services”)
provided by us and third party partners (“Partners”) and more
particularly described in the Terms of Use https://www.jainjeevan.com/,
JainJeevan’s data practices for this App, what data we collect, how we use that
data, with whom it may be shared, and your choices about such uses and
disclosures.
You understand
that through your access of this App and/ or use of our Services, you have read
and fully understand our Privacy Policy and you agree and consent to us collecting,
storing, processing, dealing, handling, transferring and/or sharing data
(including sensitive personal data) related to you with third parties or
service providers for the purposes as set out in this Privacy Policy as may be
revised from time to time. This Privacy Policy extends to both visitors to the
App who do not transact business on the App and to registered users, whether
customers or partners, who transact business on the App. If you have any

DATA WE COLLECT ABOUT YOU
For the purposes
mentioned in Clause 2 of
this Privacy Policy, we collect the following types of data:

Data you give us:
Personally identifiable data refers to
data that lets us know the specifics of who you are. When you engage in certain
activities on our App, such as setting up your account, purchasing a product,
submitting content, or sending us feedback at contact@jainjeevan.com,
we may ask you to provide certain data about yourself. To enable you to become
a registered user of our App, we need your basic personally identifiable data which
may include your first and last name, email address, mailing address, telephone
numbers, date of birth, gender, address, and if you transact business with us,
your limited financial data. To ensure your Services are enhanced, JainJeevan
may use and collect your location. We assure you that at no time will this data
be sold or shared with parties not associated with us. You can choose not to
provide certain data but then you might not be able to take advantage of many
of our features.
b.
Automatic Collection of Data:
Aggregate data, colloquially referred to
as ‘App usage statistics’- refers to data that does not by itself identify a
specific individual. We gather certain data about you based upon where you
visit on our App, and what other sites may have directed you to us. This data,
which is collected in different ways, is compiled and analyzed on both a
personal and an aggregated basis. This technology enables us to determine (i)
the IP Address of your device and its geographic location; (ii) browser type
and language, domain names, access times, referring website addresses; (iii)
your search terms or interactive behavior via our App; and (iv) your purchasing
behavior. We may use this data in
aggregate form for internal business purposes, such as generating statistics
and developing marketing plans. If you take a survey or interact with us in
various other ways – demographics data and data about subjects that may
interest you.
IP Address: When you visit our App, JainJeevan
collects your IP address to help diagnose problems with its server, administer
and tune the operation of its App, analyze trends, track traffic patterns, gather
demographic data for aggregate use, and track the date and duration of each
session within our App and similar purposes.
Cookies: Our collection of App use data
may involve the use of session cookies, web beacons, pixel tags, device
identifiers and other monitoring technologies. ‘Cookies’ are alphanumeric
identifiers or small data files that are stored by your browser on your device’s
hard drive to collect data about your activities on our App. We may authorize
third parties to use cookies and other monitoring technologies to compile data
about the use of the App or interaction with advertisements that appear on the
App. We do not have access or control over these cookies. We do not link the data
we store in cookies to any personally identifiable data you submit while on the
App. We use session ID cookies that expire when you close your browser. Among
other things, cookies help us improve our App and your experience. You can
remove or block cookies using your settings in most browsers, but if you choose
to decline cookies, you may not be able to sign in or use some of the features
offered on our App.
Web beacons: We may use web beacons and
other similar technologies, to track your use of our App. Web beacons are
electronic images that may be used to deliver cookies, count visits, understand
usage and campaign effectiveness and to tell if our e-mail, newsletter, or
notification has been opened and acted upon by you.

We might receive data about you from other sources and add it to your
account data.
2. HOW WE USE THE DATA WE
COLLECT
JainJeevan may
collect, store, access and use personal data solely to the extent required for JainJeevan
to enable you to utilize the features of the App, to use your data to fulfil
our contract to provide Services or support to you, for purposes described in
this Policy or disclosed to you on our App. Specifically, JainJeevan collects
and processes your personal data in order to:
a.
process and manage your
purchases, handle orders, deliver products and Services, process payments. Any
personal data received from you to complete a transaction, verify your credit
card, place an order, arrange for a delivery or return a purchase, shall be
deemed to be your consent for the use of such personal data by us to
effectively carry out the transaction;
b.
communicate with you about orders,
products, Services and promotional offers;
c.
update our records, or
otherwise maintain your accounts with us;
d.
display content such as wish
lists and customer reviews;
e.
perform research and analysis
about your use and interests to improve our platform, personalize and
continually improve your shopping experience on our App, recommend Services
that might be of interest to you, customize future shopping for you;
f.
enforce our Terms of Use at
https://www.jainjeevan.com/ ;
g.
prevent or detect fraud or
abuse of our App and enable third parties to carry out technical, logistical or
other functions on our behalf;
h.
respond to or take actions on
your inquiries or feedback or other App activities, post your comments on any
blog or other online forum maintained on our App;
i.
send you any newsletter(s),
mailings or offers regarding our Services or promotions. If applicable, you
will be allowed to indicate upon registration that you are or are not
interested in receiving such promotional e-mails from us. Only JainJeevan will
send you these solicitations, and only if you have previously not indicated
that you do not wish to receive them;
j.
Financial data. If JainJeevan
collects your financial data or payment method, it may be used to process
payment for any purchases, subscriptions or sales made on our App, to protect
against or identify possible fraudulent transactions, and otherwise as needed
to manage our business;
k.
JainJeevan will also use the data
to serve various promotional and advertising materials to you via display
advertisements through the Google Ad network on third party websites. You can
opt-out of Google Analytics for Display Advertising and customize Google
Display Network ads using the Ads Preferences Manager.
Your data will only be retained for as long as necessary to fulfil
the purposes for which it was obtained. As registered users, at a minimum this
will be for the purpose of providing you Services and as long as your account
is active, and likely longer depending upon applicable laws, rules and
regulations.
If you close your account, we may still retain certain data
associated with your account for analytical purposes, record keeping requirements,
to prevent fraud, collect any fees owed, enforce our Terms of Use, or take
other actions otherwise permitted by law. In addition, if certain data has
already been provided to third parties as described in this Privacy Policy with
your consent, retention of that data will be subject to those third parties’ policies.

USE BY MINORS
Our App is a general audience App, and we do not knowingly collect
personal data from minors i.e. below the age of 18. Use of the JainJeevan App
is available only to persons who can form a legally binding contract as per the
Indian law. Our App is not intended for access and/or use by minors, nor do we
collect any personal data from anyone who we know to be a minor. If you are
under the age of 18, you should not use the App and should not submit any
personal data to us. If you are a minor, you may use the JainJeevan App only
with the consent and involvement of a parent or guardian. If you are a parent
or guardian and believe we may have collected data about your child, please
contact us as described in the QUESTIONS, FEEDBACK AND GRIEVANCES
section in this Privacy Policy.
5.
WITH WHOM WE SHARE YOUR DATA
5.1 Personally Identifiable Data. We do not share your
personal data with others except as indicated below or when we inform you and
give you an opportunity to opt-out of having your personal data shared. Any
third parties to whom we may disclose personal data may have their own privacy
policies, which describe and govern the use, handling and disclosure of your
personal data after we have shared it with those third parties as described in
this Privacy Policy. If you want to learn more about their privacy practices,
we encourage you to visit the websites of those third parties. We may share
your personal data in limited ways, such as:

To trusted third-party Partners
and service providers: We may share the data with trusted entities that provide
support services to us on our behalf (such as credit card/ online money
transfer processors like PayUMoney payment gateway, data storage/management,
web hosting, web analytics, fulfillment, marketing, mailing, and emailing, human
resource support, logistics and customer relationship management agency or App
hosts or data managers), that help us serve you with our Services. These third-party service providers or
affiliated businesses with whom or on behalf of whom we provide Services
jointly- only receive personal data if such data is needed to perform their
function(s) on our behalf, and they are not authorized to use any personal data
for any other purpose(s) other than the purpose(s) set forth by JainJeevan. Further,
they must process the personal data in accordance with this Privacy Policy and
as per the applicable law.
b.
We control and operate the
Website from within the United States of America through our shared server-
Dreams International USA, Inc. Our
online privacy practices are governed by the federal laws of the United States
and the State of California in which the servers are located, which may differ
from privacy laws in India. By
submitting your personal data to us through the Website, you consent to the
transfer of your personal information to any country and its use and disclosure
in accordance with applicable U.S. Federal and State laws and with this Privacy
Policy.
c.
We may disclose specific data
(i) upon lawful request, in response to legal process, and when required to
comply with applicable laws, (ii) to enforce our agreements, corporate
policies, and Terms of Use or (iii) to protect the rights, property or safety of
JainJeevan, our employees, agents, customers, and others.
d.
If you participate in any blog,
chat box or other online forum on our App or share your feedback consenting it
to be shared by us, any personal data that you post on our App may be shared
with other App users. By making such submissions to us, you assign your rights
in the submissions to us.
e.
In the event of a merger,
acquisition, financing, or sale of assets or any other situation involving the
transfer of some or all of our business assets, we may disclose personal data
to those involved in the negotiation or transfer.
f.
Protection of JainJeevan and
Others: We release account and other personal data when we believe release is
appropriate and without your consent, to comply with applicable law; for the
purposes of verification of identity, or for prevention, detection, investigation,
prosecution or punishment of offences; enforce or apply our Terms of Use and
other agreements; or protect the rights, property or safety of JainJeevan, our
users or others. This includes exchanging data with other companies, organizations,
government or regulatory authorities for fraud protection and credit risk
reduction. Obviously, however, this does not include selling, renting, sharing
or otherwise disclosing personally identifiable data from customers for
commercial purposes in a way that is contrary to the commitments made in this
Privacy Policy.
g.
With your consent: Other than
as set out above, you will receive notice when data about you might go to third
parties and you will have an opportunity to choose not to share the data.
5.2 We may also share aggregated or anonymized data that does not
directly identify you.

HOW IS YOUR PERSONAL DATA SECURED?
We take reasonable security measures and procedures, as specified by
Information Technology Act or any other applicable law and rules made
thereunder, to maintain appropriate physical, technical, electronic, procedural
and administrative security to help prevent loss, misuse, or unauthorized
access, disclosure or modification of sensitive personal data. We work to
protect the security of your data during transmission by using Secure Sockets
Layer (SSL) software, which encrypts data you input. Our security procedures
mean that we may occasionally request proof of identity before we disclose
personal data to you.
While we take these reasonable efforts to safeguard the
confidentiality of your personal data, you acknowledge and agree that no system
or transmission of data over the Internet or any other public network can be
guaranteed to be 100% secure. By using this App, you agree that JainJeevan will
have no liability for disclosure of your data due to errors in transmission or
unauthorized acts of third-parties.
It is important for you to protect against unauthorized access to your
password and to your device. Be sure to sign off when you finish using a shared
computer or other device. Safeguarding data to help protect you from identity
theft is a top priority and we at JainJeevan take all measures to protect
identity theft. We do not and will not, at any time, request your credit card data
or national identification numbers in a non-secure or unsolicited e-mail or
telephone communication.

THIRD-PARTY LINKS AND ADVERTISEMENTS
This App may contain links and
advertisements which may lead you to other websites. Please note that once you
leave our App you will be subjected to the privacy policy of the other website
and this Policy will no longer apply. By using this App, you signify your
agreement to the terms of this Privacy Policy.

YOUR DATA PROTECTION RIGHTS AND ACCESSING YOUR DATA
If you have an account with us, you have the ability to review and
update your personal data online by logging into your account. You can also
review and update your personal data and exercise your other rights by

You have the right to be
provided on request with a copy of your personal data.
b.
You have the right to
rectification of inaccurate data we may have recorded about you.
c.
You have the right to erasure of
your data (Right to be Forgotten) which we no longer have justification for
recording.
d.
You have the right to object to
processing of your data which is being done on the basis of our legitimate
interests.
e.
You have the right to refuse to
be contacted for direct marketing purposes.
f.
You have the right to restrict
the processing of your personal data when:
i.
the basis for its processing is
in dispute;
ii.
its accuracy is in dispute;
iii.
we cannot establish a lawful
basis for its processing, but you do not wish it to be erased;
iv.
we no longer need your data,
but you need it for the establishment, exercise, or defense of legal claims;
v.
you object, where applicable,
to our processing your data on the basis of our legitimate interests, pending
verification of whether our interests override.

You have the right to be

transferred directly to another data fiduciary (“data portability”).

WHAT CHOICES DO YOU HAVE?
We offer choices for you to request to update, delete or change your
personal data and how we communicate with you. Here are some of the ways you
can request changes:
a.
Follow the opt-out instructions
in promotional emails we send you. It may take up to 10 business days for us to
process such opt-out request;
b.
Contact/Mail us @contact@jainjeevan.com.
If you opt out of receiving promotional communications from us, we
may still send you non-promotional communications such as emails about activities
in your account or our ongoing business relations.
You can usually choose to modify your cookie settings of your
browser to warn you when a cookie is being sent or to remove or reject cookies.
If you choose to remove or reject cookies, it will affect many features or
Services on our App.
Further, you can choose to withdraw your consent to the use,
disclosure or retention of your personal data. In such a case, however we will
have the option not to provide our Services, for the provision of which, the
consent to use the data was sought.

DISPUTE RESOLUTION &
GOVERNING LAW
If you have any complaints regarding our compliance with this
Privacy Policy, please contact us first. We will investigate and attempt to
resolve complaints and disputes regarding use and disclosure of personal data in
accordance with this Privacy Policy and in accordance with applicable law.
If you have an unresolved privacy or data use concern that you
believe we have not addressed satisfactorily, you may invoke third-party binding
arbitration (by a mutually appointed single arbitrator) when other dispute
resolution procedures have been exhausted.
All disputes in connection with the Privacy Policy shall be governed
and construed in accordance with laws of India and are subject to the exclusive
jurisdiction of competent Courts at Pune.
11.
LIMITATION OF LIABILITY
Notwithstanding anything to the contrary in this Privacy Policy or
any other terms of service or use applicable as between JainJeevan and you, JainJeevan’s
aggregate liability hereunder towards direct damages shall be limited to INR 1,000
(Rupees one thousand) only. JainJeevan’s liability shall not extend to any
indirect or remote damages whatsoever, including but not limited to special,
incidental, consequential, or punitive damages or loss of profits.
12.
REVISIONS TO THIS PRIVACY POLICY
We reserve the right, in our sole discretion to change, update,
modify and/or delete portions of this Privacy Policy at any time, to reflect
changes in our practices, Services and/or applicable laws. When we do so, we
will post the revised Privacy Policy on the App and revise the “Oct 25,2020”
date at the top of the Policy.
While JainJeevan shall make best efforts to notify you of any modified
versions of the Privacy Policy that might materially affect the way we use or
disclose your personal data, it shall be your responsibility to read and
understand the Privacy Policy as prevalent from time to time. We recommend you
to check the date of our Privacy Policy when you visit this App for any updates
or changes. Continued use of the App shall be deemed to constitute acceptance
of the Privacy Policy as amended.
